Terms of service for the provision of electronic services
§ 1 Preliminary provisions
1. These Terms of service for the provision of electronic services (the "Terms") define the rules for providing electronic services by Łukasz Zdanowicz, conducting business under the name PHU Łukasz Zdanowicz, ul. Stanisława Knapowskiego 20/5, 60-126 Poznań, Poland (the "Service Provider") through the website https://phiboard.com/ (the "Service") and the PhiBoard application.
2. These Terms are drawn up and implemented on the basis of Article 8 of the Polish Act of 18 July 2002 on the provision of electronic services.
3. The Services are provided free of charge. The Service Provider does not charge Users any fees for using the Service or the Application.
4. The Service Provider is entitled to amend all or part of these Terms at any time. Any changes will be published in the Service, and Users holding an Account will be notified of material changes at the e-mail address they provided.
§ 2 Definitions
The following terms used in these Terms have the following meanings:
1. Application – the PhiBoard application, available in a web browser and as a mobile application.
2. Guest – a person using a public Board without creating an Account.
3. Consumer – a natural person entering into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
4. Account – the set of the User's data in the Service, created upon registration, allowing the User to create and store their own Boards.
5. Terms – these Terms of service for the provision of electronic services.
6. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
7. Service – the Service Provider's website available at https://phiboard.com/.
8. Board – a virtual whiteboard created in the Application, together with its content; a Board may be private (available to its creator and invited people) or public (available to anyone who knows its address).
9. Agreement – a free-of-charge agreement for the provision of electronic services, concluded upon creation of an Account or, in the case of a Guest, upon starting to use a public Board.
10. Service Provider – Łukasz Zdanowicz, conducting business under the name PHU Łukasz Zdanowicz, ul. Stanisława Knapowskiego 20/5, 60-126 Poznań, Poland, e-mail: office@phiboard.com.
11. Services – the services provided electronically by the Service Provider, described in the Service and in § 3 of these Terms.
12. User – a natural person, a legal person or an organisational unit without legal personality, using the Service or the Application.
§ 3 Scope of services
1. The Service Provider provides a service consisting in making the Service and the Application available to the User free of charge. The Application is intended, among other things, for interactive learning of mathematics and science, both in person and online.
2. Within the Application the User may in particular: create Boards and work on them alone or together with others in real time, write formulas, draw figures and function graphs, use ready-made templates, load PDF files onto a Board and export a Board to a PDF file.
3. The Service also provides a knowledge base with educational materials. Using it does not require an Account.
4. The Application is available in a web browser and as a mobile application distributed through the App Store and Google Play. Downloading the mobile application is free of charge and the Service Provider offers no in-app purchases.
5. The Service Provider makes the Application available without the right to modify, correct, decompile, disassemble or resell it without the Service Provider's consent.
6. The Service Provider may develop the Application, add and modify features, and temporarily limit its availability in connection with technical work.
§ 4 Terms of service provision
1. Creating one's own Board requires an Account in the Service. Creating and using an Account is free of charge and does not require providing payment details.
2. Users are obliged to provide true and current data during registration.
3. Every User holding an Account may create an unlimited number of Boards and invite others to them. The Service Provider does not differentiate the scope of features on the basis of any fees.
4. A public Board may be joined without an Account, using the Board address alone. A Guest may co-create the content of such a Board but may not create or store their own Boards.
5. The creator of a Board decides who has access to it: they may invite and remove authorised people and change the Board from private to public and back.
6. The Service Provider is not liable for damage resulting from causes beyond its control.
7. The Service Provider is not liable for materials used by the User while using the Application that were not supplied by the Service Provider.
§ 5 Technical requirements
1. The Service Provider imposes no restrictions on the operating system used by the User on their personal computer or mobile device.
2. For correct operation, the Service and the Application require:
- broadband access to the Internet;
- an active e-mail account (for creating an Account);
- a device with an up-to-date web browser;
- enabled JavaScript, CSS and cookies.
3. Using voice chat additionally requires a device with a microphone and granting the browser or the application access to it.
4. The Service Provider is not liable for the inability to use the Application and the Service due to technical shortcomings on the User's side.
§ 6 Free-of-charge character of the Services and voluntary support
1. Use of the Service and the Application is entirely free of charge. The Service Provider offers no subscriptions, paid tiers, extended packages or in-app purchases.
2. The Service Provider does not collect payment card details or any other payment data from Users.
3. A User may voluntarily support the development of the project through the external service buycoffee.to (profile available at https://buycoffee.to/phiboard). Support is entirely voluntary, does not constitute payment for the Services and is not a condition of using them.
4. Providing support does not grant the User any additional rights, features or priority. The scope of Services is identical for supporting and non-supporting Users.
5. Payments made through buycoffee.to are carried out on terms set by its operator and do not form part of the Agreement concluded with the Service Provider.
§ 7 Voice chat on a Board
1. The Application provides a voice chat feature between people present on the same Board. Its use is voluntary and free of charge.
2. A call is started and ended solely by the creator of the Board. Other people may join an ongoing call and leave it at any time.
3. Audio is transmitted directly between participants' devices. The Service Provider does not record, listen to or store the content of calls.
4. Given how the feature works, in some network configurations (in particular corporate and school networks with restrictive firewalls) a connection may not be established. The Service Provider does not guarantee the availability of voice chat under all conditions.
5. The number of simultaneous participants in a call is limited for technical reasons; the current limit is shown in the Application.
§ 8 Copyright and User content
1. The Application constitutes a work within the meaning of the Polish Act of 4 February 1994 on copyright and related rights. In particular it may not be modified, corrected, decompiled, disassembled or sold without the Service Provider's consent.
2. Content created by the User on Boards remains the User's property. The Service Provider does not acquire copyright to it.
3. The User grants the Service Provider a free-of-charge licence solely to the extent necessary to provide the Services, that is to store the content and make it available to those to whom the User granted access to the Board.
§ 9 Personal data protection
1. The Service Provider processes Users' personal data in accordance with the GDPR.
2. The privacy policy is available at https://phiboard.com/en/privacy-policy. The cookies policy forms part of the privacy policy.
§ 10 Application data, hosting, domain
1. Application data is stored on servers of cyber_Folks S.A., with its registered office in Poznań, ul. Wierzbięcice 1B, 61-569 Poznań, KRS 0000685595 (more at https://cyberfolks.pl/).
2. The hosting and domain provider is nazwa.pl sp. z o.o., with its registered office in Kraków, ul. Pana Tadeusza 2, 30-727 Kraków, KRS 0000594747 (more at https://www.nazwa.pl/).
§ 11 Prohibition of unlawful content and moderation
1. Users undertake not to supply unlawful content. Unlawful content means content infringing personal rights, disinformation, criminal content, and content contrary to good practice, in particular content spreading or praising violence, suffering or humiliation.
2. The Application provides a mechanism for reporting content and blocking other Users. Reports are handled without undue delay, no later than within 24 hours of receipt.
3. If an infringement is found, the Service Provider may remove the content, restrict access to a Board, or block or delete the User's Account. The User will be informed of any action taken at the e-mail address assigned to the Account.
§ 12 Termination of the Agreement
1. The Agreement is concluded for an indefinite period and is free of charge.
2. The User may terminate the Agreement and delete their Account at any time - either directly, using the relevant option in the Application, or by sending a statement to office@phiboard.com. Termination involves no costs or fees.
3. Deleting an Account results in the deletion of the Boards created by the User.
4. The Service Provider may terminate the Agreement with a User who grossly or persistently breaches these Terms, after an unsuccessful request to stop the breach.
§ 13 Right of withdrawal
1. The Agreement is free of charge, therefore neither its termination nor withdrawal from it involves any costs for the User.
2. A Consumer has the right to withdraw from the Agreement within 14 days of its conclusion, without giving a reason. A withdrawal statement may be sent to office@phiboard.com; deleting the Account in the Application has an equivalent effect.
3. The provisions of this paragraph apply accordingly to a natural person entering into an agreement directly related to their business activity where it follows from the content of that agreement that it is not of a professional nature for that person.
§ 14 Complaints procedure
Users have the right to submit complaints regarding the functioning of the Service and the Application. A complaint should contain the User's details (first name, surname, address, e-mail address) and a precise description of its subject. Complaints should be submitted electronically to office@phiboard.com or sent to the Service Provider's address. Complaints will be considered within no more than 14 days of receipt.
§ 15 Final provisions
1. Using the Service and the Application constitutes acceptance of these Terms.
2. The Service Provider reserves the right to amend these Terms on the basis set out in § 1(4).
3. Any disputes arising in connection with these Terms will be settled by the court having jurisdiction over the Service Provider's registered office, provided that in disputes with a Consumer jurisdiction is determined by generally applicable law.
4. These Terms enter into force on 15 September 2026 and replace the terms of 15 April 2025.
